1. About This Privacy Policy

Wrapping Happy Inc. (“Wrapping Happy”, “we”, “us” or “our”) respects your privacy and is committed to handling personal information responsibly. This Privacy Policy explains how we collect, use, disclose, retain and protect personal information when you visit www.wrappinghappy.ca, contact us, request a quote, book or receive our services, communicate with us, or otherwise interact with Wrapping Happy. This Policy is intended to describe our practices under applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (Canada) (“PIPEDA”), where applicable, as amended or replaced from time to time.

This Policy applies to personal information relating to individual customers, prospective customers, client representatives, gift recipients, event contacts, website visitors and other individuals whose information we handle in the course of our commercial activities. In this Policy, “you” means the individual concerned in the situation being described. Some parts apply to customers who book our services, and others apply to anyone whose personal information we hold. This Policy does not address information about our employees, contractors or job applicants, or information that is not personal information under applicable law.

Personal information means information about an identifiable individual. Depending on the circumstances, business contact information used only to communicate with an individual in relation to their employment, business or profession may not be treated as personal information under applicable privacy law.

2. Personal Information We Collect

The personal information we collect depends on how you interact with us and the services you request. It may include:

  • Contact and identity information, such as name, mailing or service address, email address, telephone number and signature, including for a client representative or on-site contact.

  • Quote, booking and service information, such as the requested service date, time and location; event or project details; gift quantities; wrapping, branding and material preferences; access, parking and delivery instructions; and other information needed to quote, schedule and perform the services.

  • Gift recipient and fulfilment information provided by you, such as recipient names, delivery addresses, telephone numbers, labels, gift messages, sorting instructions and other details needed to assemble, pack, ship, deliver or release gifts to a courier.

  • Transaction and payment information, such as quotes, service agreements, invoices, deposits, amounts paid, payment method and transaction records. Where payments are processed by a third-party payment service provider, that provider may collect and process payment-card information in accordance with its own privacy practices.

  • Communications and customer-service information, including emails, telephone or text communications, requests, instructions, feedback, concerns and records of our dealings with you.

  • Photographs, video and related information, including images of completed wrapping work, displays, materials, set-up and behind-the-scenes work, and any client name, logo, event details or other information appearing in or associated with those images.

  • Website and device information, which may include Internet Protocol address, browser and device type, operating system, referring pages, pages viewed, approximate location derived from an IP address, dates and times of visits, and information collected through cookies or similar technologies.

  • Other information you choose to provide, or that we are permitted or required by law to collect.

Some project information may be sensitive, including home addresses, information about private events or surprise gifts, identifiable images, and information concerning high-profile or vulnerable recipients. Unauthorized access to or disclosure of this information could create privacy, safety, reputational or other harm. Please tell us about any special confidentiality requirements and avoid providing sensitive information that is not reasonably necessary for the project.

Please do not provide more personal information than is reasonably needed for your inquiry, booking or project. If you provide personal information about another individual, including a gift recipient, please confirm that you have authority to provide it for the requested services. Wrapping Happy remains responsible for personal information under its control and will use and disclose recipient information only for the purposes described in this Policy or as otherwise permitted or required by law.

3. How We Collect Personal Information

We may collect personal information:

  • directly from you by email, telephone, text message, through our website, in a quote request, service agreement, invoice or payment, during an in-person or on-site service, or through another communication with us;

  • from a business or individual who engages us and provides information about its representatives, on-site contacts, guests, customers, employees, gift recipients or other people involved in a project;

  • from service providers involved in payments, website hosting, electronic signatures, accounting, shipping, courier services or other business operations;

  • from referrals, where permitted by law; and

  • automatically when you use our website, through cookies and similar technologies that may be used by us or our website service providers.

When you request a quote through our website or by email, we collect the information you choose to provide, such as your name, contact information and project details.

4. How We Use Personal Information

We may use personal information for the following purposes:

  • to respond to inquiries, prepare quotes and proposals, assess project requirements, communicate with you and provide customer service;

  • to enter into and administer service agreements, schedule and perform gift wrapping, packing, fulfilment, mobile, on-site, retail, event, workshop, delivery and related services;

  • to identify, sort, label, assemble, pack, ship, deliver or release gifts and packages as instructed;

  • to process deposits and payments, issue invoices and receipts, maintain transaction and accounting records, and collect amounts owing;

  • to coordinate staff, contractors, venues, suppliers, couriers, shipping providers and other service providers involved in a project;

  • to understand and improve our services, website, customer experience, business operations and marketing;

  • to create and use photographs or video where permitted by the applicable service agreement, your instructions and applicable law;

  • to send service-related communications and, with consent or as otherwise permitted by law, promotional communications;

  • to protect our business, customers, personnel and property; prevent or investigate fraud, misuse, security incidents, claims or disputes; enforce agreements; and obtain legal, accounting, insurance or other professional advice;

  • to comply with legal, regulatory, tax, accounting, insurance and reporting requirements; and

  • for another purpose that is identified when the information is collected, that you consent to, or that is permitted or required by law.

5. Consent and Your Choices

We collect, use and disclose personal information with consent, except where consent is not required or where collection, use or disclosure without consent is permitted or required by law. Consent may be express or implied, depending on the nature and sensitivity of the information and the reasonable expectations of the individual.

You may decline to provide personal information that is optional. However, if information is reasonably required to prepare a quote, enter into an agreement, process payment, perform the services, arrange delivery or meet a legal requirement, we may be unable to proceed without it.

You may withdraw consent to a use or disclosure of personal information at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal will not affect uses or disclosures already made with valid consent, and we may retain information where permitted or required by law.

If we send promotional electronic messages, you may withdraw your consent or unsubscribe using the method provided in the message or by contacting us. Service, booking, payment, safety and other transactional communications are not promotional communications and may still be sent when necessary.

6. When We Share or Transfer Personal Information

We do not disclose personal information except as described in this Policy, with consent, or as permitted or required by law. We may make personal information available to:

  • our employees and contractors who need the information to quote, schedule, coordinate or perform services and who are expected to protect its confidentiality;

  • website hosts, cloud and email providers, electronic-signature providers, payment processors, bookkeeping, accounting and payroll providers, customer-management tools, file-storage providers, technology support and other suppliers that process information for us;

  • couriers, shipping companies, delivery providers, venues, event contacts, suppliers and other providers where needed to perform a project or follow your instructions;

  • lawyers, accountants, insurers, brokers and other professional advisors;

  • government, regulatory, law-enforcement or other authorities where permitted or required by law; and

  • a purchaser, investor or other party involved in a proposed or completed sale, financing, reorganization or transfer of all or part of Wrapping Happy, subject to appropriate protections and applicable law.

When a service provider processes personal information on our behalf, Wrapping Happy remains accountable for the information under applicable law. We use contractual or other measures appropriate to the circumstances to require service providers to protect the information and use it only for authorized purposes.

We do not sell or rent personal information to third parties.

Some service providers may store or process personal information outside Ontario or outside Canada. In that case, the information may be subject to the laws of the jurisdiction where it is processed and may be accessible to courts, law-enforcement or government authorities in that jurisdiction in accordance with applicable law. You may contact our Privacy Officer for more information about our use of service providers outside Canada.

7. Photography, Video, Portfolio and Marketing

Wrapping Happy may photograph or record completed wrapping work, displays, materials, set-up or behind-the-scenes work for quality-control and internal business purposes where reasonably necessary. A photograph or video that does not identify an individual or client and does not reveal private or confidential information may also be used for portfolio and promotional purposes where permitted by the applicable service agreement, your instructions and applicable law.

Before using a photograph or video for portfolio or marketing purposes where it includes an identifiable individual or gift recipient, a client name or logo, a private address or event, or reveals a confidential, surprise or embargoed gift or project or other sensitive or confidential information, we will obtain express written consent from the person or organization authorized to provide it. The consent may be included in the service agreement or a separate release and will identify the permitted uses.

A client may also notify us in writing before services begin that a project is not publishable or may be published only after a stated date. We will comply with those written restrictions and will not publish the project before any stated date. An embargo date does not replace any express consent required for identifiable or sensitive marketing content.

If a photograph or video includes personal information, we will handle that information in accordance with this Policy. Requests concerning future use of an image may be sent to the contact information below, subject to legal, contractual and practical limitations.

8. Website Cookies and Similar Technologies

Our website and its service providers may use cookies and similar technologies to operate the website and collect technical information about its use. Cookies are small files stored on a browser or device.

You can adjust browser settings to block or delete cookies. Some website features may not work properly if cookies are disabled. Where required, we will provide additional notice or choices for non-essential cookies.

We may introduce additional analytics, social media or advertising technologies in the future. If we do, we will update this Privacy Policy to reflect those tools and the information they collect.

9. Retention and Disposal

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to provide services and maintain appropriate business records, and to meet legal, tax, accounting, insurance, limitation-period and dispute-resolution requirements. Different types of records may be retained for different periods.

When personal information is no longer reasonably required, we will securely destroy, delete or anonymize it, subject to applicable law and reasonable backup and record-management practices.

10. Safeguards

We use reasonable administrative, technical and physical safeguards appropriate to the sensitivity of the personal information in our control. These may include limiting access to people who need the information for their work, confidentiality obligations, password-protected systems, secure service providers, staff training, and reasonable measures for protecting paper and electronic records.

No method of transmission or storage is completely secure. We cannot guarantee absolute security, but we will investigate and respond to suspected privacy or security incidents and provide any notices required by applicable law.

11. Access, Correction and Privacy Requests

You may ask whether we hold personal information about you and request access to that information, subject to applicable legal exceptions. You may also ask us to correct information that is inaccurate or incomplete, withdraw consent where applicable, or raise a question or concern about our privacy practices.

A request should be made in writing using the contact information below and should provide enough detail for us to identify the relevant information. We may need to verify your identity before responding. We will respond within 30 days, subject to any extension or different period permitted or required by applicable law, and will explain any lawful reason for refusing or limiting access.

12. Children

Our website and services are not directed to children, and we do not knowingly collect personal information directly from children without appropriate consent. A client may provide limited information about a child who is a gift recipient or event participant where needed to provide the requested services. Clients should provide only the information reasonably necessary for that purpose.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our services, technologies, business practices or legal obligations. Any updated version will be posted on our website and will identify when it was last updated. If a change is material, we may provide additional notice or obtain consent where required by law.
